Limited Warranty  

Provisions & Limitations on Liability 

The limited warranty period commences on the original purchase date and covers material and production defects, or failure of the product to operate as specified by OASE during the duration of the limited warranty period. This limited warranty does not cover failure or problems relating to:  

• Improper or incorrect installation of the product (refer to these instructions of use regarding proper installation);
• Modification of the product in any way including attempts to repair the product by someone other than an OASE authorized repair technician;
• Normal wear and tear (including, but not limited to, wear and tear related to pump impellers, filter mats and filter media in filters, bulbs in lights and UV water treatment basins);
• Failure to observe or follow safety, care and maintenance instructions as outlined in these instructions for use or as set forth by OASE from time to time;
• Defects or damage resulting from improper treatment;
• Defects or damage resulting from product misuse (including, but not limited to, non-observance of the instructions for use)

OASE’s sole liability under this limited warranty shall be to replace or repair the product covered by this limited warranty. OASE shall not be subject to liability for any consequential damage to any other part of the water garden, pond, water feature system, landscape, aquarium, paludarium, structure or the contents of any structure where the product is located or used, construction or part of the construction where the product is located or used, including no liability for damage or harm to fish, animals or water plants in, around or surrounding the water garden, pond, water feature system, aquarium, aquatic systems, or paludarium. 

THE EXPRESS WARRANTIES SET FORTH HEREIN ARE THE ONLY WARRANTIES WITH RESPECT TO THE PRODUCTS, AND THE REMEDIES SET FORTH HEREIN ARE THE EXCLUSIVE REMEDIES IN THE EVENT OF A BREACH OF SUCH WARRANTIES. OASE EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. OASE SHALL NOT BE SUBJECT TO LIABILITY UNDER ANY CIRCUMSTANCES FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE, FOR ANY BREACH OF SUCH WARRANTIES OR OTHERWISE. 

Some states do not allow the exclusion or limitation of incidental or consequential damages, to the above limitation may not apply to you. Should your OASE product be defective or fail under the terms of this limited warranty, you should return the product to your OASE dealer, along with your original receipt of purchase and any other limited warranty documentation you have, for replacement or repair.

Extended Warranty 

OASE may grant a one-time extension, based on the product, of our advertised manufacturer‘s warranty by 1 year. In special cases we may grant an extension of a warranty an additional 2 years, under the same warranty conditions. Special restrictions apply. We grant the extension warranty only to end customers who have purchased the product from an OASE dealer and who do not commercially resell the product and install it on the premises of third parties in the course of their professional activities. 

The extension warranty can be acquired through online registration with submission of a copy of the original purchase receipt. 

The term of the warranty period starts with the expiration of the first warranty, with the prerequisite that the product was verifiably purchased from an OASE dealer. Therefore, in the event of resale the warranty period does not begin at a later point in time, nor does it start over again. The warranty period is neither extended nor restarted through warranty performances.  

At OASE’s discretion the warranty performance extends to free-of-charge repair of the defective part or replacement delivery of a comparable / equivalent value product with exclusion of more extensive claims. In addition, in a warranty case, we shall accept the appropriate costs for sending in the defective product and the return delivery. More extensive claims are excluded. The legal rights of the purchaser are not limited by this warranty. 

The guarantor is OASE North America, Inc. 

In the absence of a deviating agreement, OASE collects your data exclusively for processing of the described warranty, particularly for assurance of your identity and verification of the purchase object and the time of purchase. This data is used solely by OASE and is not disclosed to any third party.
